Terms and Conditions for Boutique Resort Cattunari di Valle
1. Definitions
In these terms and conditions, the following terms are defined as:
- Resort: Boutique Resort Cattunari di Valle, located at Donji Katunari 39-44, 52474 Brtonigla, Istria, Croatia, owned by De.Ca doo.
- Guests: The person or persons making a reservation for a stay at the resort.
- Reservation: The booking of accommodation, including any additional services such as facilities, etc.
- Facilities: All services and amenities provided by the resort, including but not limited to accommodation, swimming pool, and activities.
2. Applicability
These terms and conditions apply to all agreements, reservations, and stays of guests at the resort. By making a reservation, the guest agrees to these terms and conditions, as well as the house rules of the resort, which can be found on the website www.cattunaridivalle.com.
3. Reservations and Payments
- Reservation: Reservations can only be made via email.
- Confirmation: The guest will receive a reservation confirmation with a request to pay the deposit within 5 days of receiving the booking confirmation.
- Payment: Payment must be made within the timeframe mentioned in the confirmation.
- Deposit: A 30% deposit is required for reservations. The remaining balance must be paid no later than 60 days before the arrival date.
- Payment Method: Payments are made by bank transfer.
4. Cancellations and Changes
- Cancellation by Guest: The resort recommends guests to take out a travel and cancellation insurance. Cancellations must always be made in writing.
- Cancellation within 5 days after reservation: no charge.
- Cancellation between 5 days and 30 days after reservation: The guest is liable for 30% of the amount (the deposit).
- Cancellation between 31 days after reservation and 60 days prior to arrival: The guest is liable for 60% of the total amount.
- Cancellation within 60 days prior to arrival: The guest is liable for 100%.
- Cancellation by Resort: The resort reserves the right to cancel a reservation in case of force majeure, such as natural disasters, fire or other unforeseen circumstances. In this case, the amount paid will be refunded, or the guest can choose an alternative date.
- Refund: In the event of cancellation by the resort, the refund is limited to the amount paid, and the guest is not entitled to any additional compensation.
- Changes to Reservation: Changes to reservations are subject to availability and may result in additional costs.
5. Arrival and Departure
- Check-in: Check-in is from 16:00 on the day of arrival.
- Check-out: Check-out is before 09:30 on the day of departure.
6. Code of Conduct and House Rules
- Guests must behave respectfully and responsibly during their stay at the resort. Discrimination, violence, or harassment is not tolerated.
- Noise disturbance must be avoided, particularly between 22:00 and 09:00 hours.
- Pets are not allowed.
- The resort is a non-smoking area. Smoking is only allowed outside the resort gates.
- By making a reservation, the guest agrees to these terms and conditions as well as the house rules of the resort.
7. Resort’s Responsibility and Liability
- The resort is not liable for the loss, damage or theft of personal belongings during the guest’s stay.
- The resort is not responsible for accidents or damage caused by the guest’s negligence.
- The guest stays at the resort at own risk.
- The guest use the facilities at own risk.
- The resort is not liable for the malfunction of facilities, water supply, electricity failure, poor Wi-Fi connection, etc.
- The resort is not liable for disturbances caused by external activities, agricultural work, regular garden maintenance, work in the area, other guests, etc.
- The guest may not hold the resort responsible for obvious errors or mistakes in descriptions or pricing of resort facilities.
8. Force Majeure
In cases of force majeure, such as natural disasters, pandemics, strikes, etc., the resort has the right to suspend or cancel the agreement. Guests will be informed as soon as possible, and the payment will be (partially) refunded or an alternative date will be offered.
9. Privacy and Data Protection
The resort collects and processes personal data of guests solely for the management of reservations and services. Personal data will not be shared with third parties without the guest’s consent, unless required by law (e.g., for tourist tax registration).
Guests have the right to access, correct or delete their data in accordance with applicable privacy laws.
10. Complaints and Disputes
- If the guest has a complaint, it can be reported to the manager or emailed to info@cattunaridivalle.com.
- In case of a dispute between the guest and the resort, the resort will attempt to resolve the issue amicably. If this is not possible, the dispute may be submitted to a competent court.
11. Final Provisions
- The resort reserves the right to amend these terms and conditions at any time. The updated terms will apply from the moment they are published on the website or when the guest makes a new reservation.
- If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect
